If fare rules allow cancellations, you will not receive a monetary refund when canceling. Instead, you will receive a credit (less any applicable Supplier fees) towards a future ticket purchase on an international flight of equal or higher value; such credit will be valid for up to twelve (12) months from the original date of purchase and during this period all travel must be complete. The validity of this credit depends on the specific fare rules.

SUPPLIER RULES AND RESTRICTIONS
Additional terms and conditions will apply to your reservation and purchase of travel-related goods and services that you select from both airline and hotel suppliers. Please read these additional terms and conditions carefully on the airline or hotel or other accommodation providers websites. You agree to abide by the terms and conditions of purchase imposed by any supplier with whom you elect to deal, including, but not limited to, payment of all amounts when due and compliance with the suppliers rules and restrictions regarding availability and use of fares, products, or services. We reserve the right to cancel your booking if full payment is not received in a timely fashion. Some airline or hotel suppliers may require you to present a credit card or cash deposit upon check-in to cover additional expenses incurred during your travel. Such deposit is unrelated to any payment received by Flight Portal or your booking. You acknowledge that some third-party providers offering certain services and/or activities may require you to sign their liability waiver prior to participating in the service and/or activity they offer. You understand that any violation of any such suppliers rules and restrictions may result in cancellation of your reservation(s), in your being denied access to the applicable travel product or services, in your forfeiting any monies paid for such reservation(s), and/or in our debiting your account for any costs we incur as a result of such violation.

Name Changes.
Name changes are not allowed, only the original Passenger can use the ticket(s). No Show Tickets. “No-show” tickets have no value. A “no-show” status will be applied when a Passenger has not showed up for the outbound flight and has not processed a cancellation. Flight Portal Inc is not responsible if the Passenger misses his/her flight by being late for check-in or at the gate. If the Passenger misses his/her flight, you must first contact the airline representative at the airport as they have the best ability to reschedule Passengers on alternative flights. If this is unsuccessful, please contact your Flight Portal Inc agent.

Missed Flights.
Missed flights are not refundable and non-exchangeable, changes or replacement flights will be at the discretion of the Supplier. Flight Portal Inc will use reasonable efforts to assist you, but it cannot guarantee a replacement flight.Schedule Changes. If your ticket is not honored for any reason, please contact your Flight Portal Inc agent immediately. Your ticket is guaranteed up to the original paid amount, and Flight Portal Inc will replace your ticket within 24 hours or provide other alternative options within 24 hours. Baggage Allowance.
Passengers may have to pay additional fees at the airport if their checked luggage exceeds weight, size or quantity allowed in the standard baggage allowance by the airline. Some airlines do not offer any free baggage allowance. Requirements may change and you should check for up-to-date information before booking and departure. We accept no liability if the Passenger is refused entry onto a flight or into a country due to failure to carry correct and adequate passport, visa, or other travel documents required by any airline representative, government or border control authority, including countries the Passenger may just be transiting through even if the Passenger does not leave the aircraft or airport.

If we are not able to resolve your Claims within 60 days, you agree to seek relief exclusively through binding arbitration or in small claims court, as set forth below. Exclusive Arbitration: You hereby agree that any and all Claims will be exclusively resolved by binding arbitration, rather than in court, except you may assert Claims on an individual basis in small claims court if they qualify. This includes any Claims you assert against Flight Portal Inc or its affiliates, Suppliers or any third party offering Travel Products through the Website or Services (which you hereby acknowledge and agree that are beneficiaries of this arbitration agreement). This also includes any Claims that arose before you accepted these Agreement, regardless of whether prior versions of the Agreement required arbitration. There is no judge or jury in arbitration, and court review of an arbitration award is limited. However, an arbitrator can award on an individual basis the same damages and relief as a court (including statutory damages, attorneys’ fees and costs), and must follow and enforce these Agreement as a court would. The Parties agree that any dispute, difference or controversy which may arise out of or in connection with this Agreement or any breach thereof, shall be initially subject to amicable settlement between the Parties. If the dispute cannot be settled through amicable settlement within 30 (thirty) Business Days from the date when either the Purchaser or the Seller requested the other to proceed with amicable settlement, each Party is entitled to initiate arbitration proceedings. Subject to the failure of amicable settlement, all disputes arising from this Agreement or related to its violation, termination or nullity shall be referred to and finally settled under the rules of arbitration of the International Chamber of Commerce as are in force at the time of any such arbitration. The number of arbitrators shall be 3 (three). Each Party shall appoint 1 (one) arbitrator and the 2 (two) appointed arbitrators shall jointly appoint the third arbitrator who will act as the chairman of the arbitral tribunal. All arbitration proceedings shall be conducted in the English language and the documents may also be produced and the testimony may be taken in English and the place of arbitration shall be in Switzerland. The arbitration shall be in lieu of any other remedy. The award shall be final and binding on the Parties thereto, and each Party hereby waives its right to set aside the award for any reason whatsoever. No Class Action: Waiver of Jury Trial: Any and all proceedings to resolve Claims will be conducted only on an individual basis and not in a class, consolidated or representative action whether in arbitration or in court. If for any reason a Claim proceeds in court rather than in arbitration, we each hereby waive any right to a jury trial. Governing Law: This Agreement shall be governed by and construed in accordance with the laws of the State of California, U.S.A., without regard to any conflicts of laws principles that would require the laws of another jurisdiction to apply. The Federal Arbitration Act and federal arbitration law apply to this Agreement. This Agreement will not be governed by the following, the application of which is hereby expressly excluded: (x) the conflict of law rules of any jurisdiction, (y) the United Nations Convention on Contracts for the International Sale of Goods, and (z) the Uniform Computer Information Transactions Act, as enacted in any jurisdiction. The award rendered by the arbitrator shall include costs of arbitration, reasonable attorney’s fees and reasonable costs for expert and other witnesses, and judgment on such award may be entered in any court with competent jurisdiction. Injunctive Relief: Notwithstanding the foregoing, nothing in this Agreement will be deemed to prevent Flight Portal Inc from seeking injunctive relief (or any other provisional remedy) from any court of competent jurisdiction as necessary to protect its rights pursuant to this Agreement. The prevailing party in any suit will recover its reasonable attorney’s fees and costs, including expert costs, from the other party.
